In the housing market, amenities and location have as much to do with a home’s value as the everyday forces of supply-and-demand. Whereas the latter causes home values to rise and fall over time, the former creates a starting point for said values.

Where you live — and the features of your home — determine your home’s price range. Naturally, homes in some areas are consistently higher-valued than homes in others.

Using data compiled by real estate market data firm Altos Research, Forbes Magazine presents America’s 10 most expensive ZIP codes. California and the New York Metro area dominate the list.

Alpine, NJ (07620) : $4,550,000

Atherton, CA (94027) : $4,295,000

Sagaponack, NY (11962) : $3.595,000

Hillsborough, CA (94010) : $3,499,000

Beverly Hills, CA (90210) : $3,469,891

New York, NY (10012) : $3,392,574

New York, NY (10013) : $3,317,962

Water Mill, NY (11976) : $3,300,000

Montecito, CA (93108) : $3,099,348

Old Westbury, NY (11568) : $3,095,000

In fact, of the top 50 most expensive ZIP codes, only 6 are located outside of California and New York regions. 3 are Colorado resort towns — Snowmass (81654), Aspen (81611) and Telluride (81435) — one is in Maryland, one is in Florida, and the last is in Washington State.

Chicago-suburb Kenilworth (60043) is the top-ranked Midwest ZIP code. It placed 86th overall.

The Forbes list may be interesting but, to home buyers or sellers in Mesa , it should not be the final word in home values. Real estate is a local market which means that — even within a given ZIP code — prices can vary based on street and neighborhood.

Look past general data and get specific. Talk to your real estate agent for local market pricing.

Headlines in newspapers can be misleading — especially with respect to housing figures. Media coverage of the most recent Housing Starts data serves as an excellent illustration.

Wednesday, the Census Bureau released its September Housing Starts report. In it, the government said that national Housing Starts rose 15 percent in September as compared to August 2011, tallying 658,000 units on a seasonally-adjusted annualized basis.

The September reading is the highest monthly reading since April 2010, the last month of last year’s home buyer tax credit.

The sudden surge in starts is big news for a housing market that has struggled of late, and the press was eager to carry the story. Here is a sampling of some headlines:

§ U.S. Housing Starts Rise 15%, Hit 17-Month High (MarketWatch)

§ Home Building Jumps 15% in September (ABC)

§ New Construction Surges In September (LA Times)

These headlines are each accurate. However, they’re also misleading.

Yes, Housing Starts did surge in September, but if we remove the “5 or more units” grouping from the Census Bureau data — the catgory that includes apartment buildings and condominium structures — we’re left with Single-Family Housing Starts and Single-Family Housing Starts rose just 1.7 percent last month.

That’s a good number, but hardly a great one. And for home buyers and sellers throughout Mesa and nationwide, it’s the Single-Family Housing Starts that matter most. Individuals like you and I don’t buy entire apartment buildings. Most often, we buy single-family homes. Therefore, that’s the data for which we should watch.

The good news is that media tales work in both directions.

Building Permits dropped 5 percent last month when the volatile 5-unit-or-more-units category was included from the math. Isolating for single-family homes, we find that permits were unchanged.

This is good housing because 82% of homes begin construction within 60 days of permit-issuance, hinting at a steady, late-fall housing market.

Standard & Poors released its monthly Case-Shiller Index this week. The Case-Shiller Index measures home price changes from month-to-month, and year-to-year, in 20 select U.S. cities. It also reports a “national” index; a composite of the values in said cities.

The most recent Case-Shiller Index shows a 0.9% rise in home values from June to July 2011. Home values were higher in 17 of the 20 tracked cities. Only Phoenix and Las Vegas fell. Denver was flat.

Also noteworthy is that, of all of the Case-Shiller cities, Detroit posted the strongest 1-year, home price improvement. As compared to July 2010, home values are higher by 1.2 percent in Detroit. This bests even Washington, D.C. — long-believed to be the nation’s healthiest housing market.

That said, we should be careful of the conclusions we draw from July’s Case-Shiller Index — both on a city-wide level, and on a national level. This is because, as with most “home price trackers”, the Case-Shiller Index has flaws in its methodology.

The first Case-Shiller Index flaw is its limited scope. Although it’s purported to be a “nationa”l housing index, the data that comprises the monthly Case-Schiller Index is sourced from just 20 U.S. cities. These 20 cities represent just 0.6% of the more than 3,100 municipalities nationwide.

The second Case Shiller Index flaw is that the sample sets include single-family, detached homes only. iCondominiums, multi-unit homes, and new construction are specifically excluded from the Case-Shiller Index.

In some markets, “excluded” home types outnumber included ones.

And, lastly, the Case-Shiller Index is flawed in that it takes 2 months to gather data and report it. It’s nearly October, yet we’re still discussing the real estate market as it existing in July. For buyers and sellers in Scottsdale , July in ancient history.

The Case-Shiller Index is useful for tracking long-term trends in housing, but does little to help individuals with their choices to buy or sell a home. For relevant, recent real estate data, talk to a real estate agent in your market. Real estate agents are often the best source for real-time, real estate data.

The Federal Open Market Committee adjourns from a two-day, scheduled meeting today, the sixth of 8 scheduled meetings this year, and the seventh Fed meeting overall.

The FOMC is a designated, 12-person committee within the Federal Reserve, led by Fed Chairman Ben Bernanke. The FOMC is the voting members for the country’s monetary policy. Among its other responsibilities, the FOMC sets the Fed Funds Rate, the overnight rate at which banks borrow money from each other.

Note that the “Fed Funds Rate” is different from “mortgage rates”. Mortgage rates are not set by the Fed. Rather, they are based on the price of mortgage-backed bonds, a security traded among investors.

As the chart at top illustrates, the Fed Funds Rate and conforming mortgage rates in Mesa have little correlation. Since 1990, the two benchmark rates have been separated by as much as 5.29 percent, and have been as close as 0.52 percent.

Today, the separation between the Fed Funds Rate and the national average for a standard, 30-year fixed rate mortgage is roughly 4 percent. This spread will change, however, beginning 2:15 PM ET Wednesday. That’s when the FOMC adjourns from its meeting and releases its public statement to the markets.

There is no doubt that the Fed will leave the Fed Funds Rate in its current target range of 0.000-0.250%; Fed Chairman Bernanke plans to leave the benchmark rate as-is until at least mid-2013. However, the Fed is expected to add new support for markets.

Unfortunately, there are few clues about how the Fed will support markets, and there is no consensus opinion regarding the size of the said support. As a result, mortgage rates should be bouncy today. First, they’ll be volatile ahead of the Fed’s statement. Then, they’ll be volatile post-Fed statement.

Even if the Fed does nothing, mortgage rates will change. This is because Wall Street is prepping for an announcement and — no matter what the Fed says or does — investors will want to react accordingly.

When mortgage markets are volatile, the safest move is to lock your mortgage rate in. There too much risk to float.

A successful short sale closing, this has been a long one… times when we all thought it wouldn’t happen. PHH was very slow at times however they did come through and close the transaction! So congratulations to the B’s they can move on, and the O’s as they can move in!

I can’t thank my Sellers enough for hanging in there, it is difficult… they lose hope and think that this is never going to work.. The bank makes demands that they need paperwork by a deadline, however the bank doesn’t have to have any deadlines. We worked this short sale for a year! I don’t want to know what my per hour is on this one, what I can tell everyone is that this is why I do what I do, my Sellers do not have a foreclosure on their credit and the burden is lifted, big smiles. Life can get back to normal.

Mortgage bonds worsened last week as Eurozone default fears eased abroad, and expectations for a domestic stimulus increased.

Mortgage rates rose for the first time in three weeks last week, pushing conforming and FHA mortgage rates in AZ off their all-time, historical lows. Rates were at their lowest Tuesday morning, then rose through Friday’s afternoon closing.

Markets open this week with an eye toward the world’s central banks.

In the Eurozone, central bankers (continue to) discuss the debt burdens of Greece and whether a coordinated intervention is necessary. Without it, some economists believe that the nation-state will default on its sovereign debt, which would then create additional financial stress within other nations in the region.

Italy is included among those countries.

In the United States, central bankers are making equally-important choices.

The Federal Open Market Committee will emerge from a 2-day meeting Wednesday and is expected to announce new stimulus for the U.S. economy.

Since 2009, the Federal Reserve has twice stimulated the economy via an open-market, bond buying initiative. The programs created demand for mortgage bonds which, in turn, lowered mortgage rates for U.S. homeowners. If the Fed chooses this path a third time, expect for mortgage rates to fall in Phoenix.

If the Fed’s sponsored stimulus is something else, however — or if the Fed choose to do nothing — mortgage rates may rise.

There is economic data due this week, including the Existing Home Sales and Housing Starts report, but it will be the world’s central bankers that sit in spotlights.

Expect volatile mortgage rates this week. Wall Street can only guess what governments will do to stimulate their respective economies and can lead to wild swings in pricing. The “safe play” is to lock a rate while we’re still near all-time lows.

Once rates reverse higher, they’re expected to rise quickly.

AG HORNE WARNS HOMEOWNERS: MORTGAGE LAWSUIT SCAM HITS ARIZONA

PHOENIX (Monday, August 22, 2011) -- Attorney General Tom Horne today issued a warning to consumers to be wary of any notices or advertisements that claim to offer homeowners facing foreclosure “complete forgiveness of the loan” or other monetary relief if they join a class-action lawsuit. Such ploys are likely a pretext to collect illegal up-front fees for foreclosure assistance.

In class action litigation, consumers generally do not have to pay to join, and most reputable firms will not charge a fee for attorneys to review your case or to determine if you are eligible to join a lawsuit.

“The mortgage crisis is only made worse by predators who take advantage of consumers who are already facing the loss of their home,” Horne said. “State and federal law ban almost all types of up-front fees for foreclosure assistance. I am committed to prosecuting anyone who engages in this type of consumer fraud, and it is just as important that consumers be vigilant against these types of scams.”

The California Attorney General recently filed a lawsuit against California lawyer Philip Kramer, the Law Offices of Kramer & Kaslow, plus 19 other lawyer and non-lawyer individuals and companies, for deceptively marketing class action or “mass joinder” lawsuits. The defendants in that case are believed to have taken over $7 million in fees from homeowners in 17 states – including Arizona - after sending out hundreds of thousands of flyers advertising the program. The lawsuit alleges that the defendants advertised nationwide settlements against lenders that did not exist and that many servicers were not provided by lawyers or legal staff.

Notices may be mailed to homeowners or posted on their doors. Typically, the business claims that the fee they are charging is for a forensic audit of your loan documents to see if you are eligible to join the class action litigation. However, the Federal Trade Commission’s Mortgage Assistance Relief Services Rule (“MARS Rule”) contains a broad ban on requesting or collecting up-front fees for almost all types of mortgage assistance, including forensic audits related to foreclosure relief. Arizona’s foreclosure consultant statute also prohibits companies from collecting an up-front fee for assisting homeowners in foreclosure.

Foreclosure rescue companies may promise to refund your fee if you are not eligible to join the litigation. However, the Office’s experience with guaranteed refunds indicates that they are very difficult to obtain, or the company may disappear before the refund is paid. If you are facing foreclosure, refuse to pay up-front fees and instead contact the Arizona Foreclosure Prevention Helpline at (877) 448-1211 for free assistance provided by HUD approved housing counseling agencies.

Mortgage markets improved again last week, pushing mortgage rates in AZ to an all-time low; lower than the lows set last November, even.

Last week’s low mortgage rate drivers are primarily European. Joining the debt concerns that have dogged Europe since March, a fresh wave of doubt has surfaced about the health of some Eurozone banks. The fears sparked a new wave of safe haven buying.

Global equities were socked last week and the Dow Jones Industrial Average fell for the 4th straight week. For home buyers in Phoenix , though, the timing may be perfect. As stock markets lose, bond markets gain and when bond markets gain, mortgage rates drop.

According to government-group Freddie Mac’s weekly mortgage rate survey, the average 30-year fixed rate mortgage fell to 4.17% last week with 0.7 points. This is the lowest rate-and-points combination in history.

The 5-year ARM fell to 3.08 with 0.5 points.

As mortgage rates fall, though, be wary of trying to “time the market”. It’s impossible to know when rates have bottomed and mortgage rates tend to spike without notice. That’s what happened in May 2010. And then again in November 2010. And then a third time in April 2011.

When rates rise, they could tack on 0.500% or more overnight.

This week, there is a lot that can move mortgage rates. With housing data set for Tuesday release, the Eurozone stories still unfolding, and three Treasury auctions planned, it’s best to be ready for locking.

If you’re floating a mortgage rate or still shopping, consider locking your rate as soon as possible. Rates trended higher to close out last week and will be riding that momentum forward. Rates are lower than they’ve been in history.

Take advantage of it.

IRS's top 10 tax tips for home sellers

From time to time the IRS releases tips designed to help people with their taxes. Some of these are quite useful.

Last week the agency released "Ten Tax Tips for Individuals Selling Their Home," (IRS Summertime Tax Tip 2011-15).

As a real estate agent or broker, it is not your job to give home sellers tax advice. Indeed, it is advisable not to, since you could end up getting sued if you give wrong advice.

Instead, refer sellers to this list of IRS tips. It's a good starting place for them to begin to understand this often complex area of tax law. You could even print it out and hand it to anyone who asks you about these issues.

Here are the IRS's top 10 tax tips for home sellers:

1. In general, you are eligible to exclude the gain from income if you have owned and used your home as your main home for two years out of the five years prior to the date of its sale.

2. If you have a gain from the sale of your main home, you may be able to exclude up to $250,000 of the gain from your income ($500,000 on a joint return in most cases).

3. You are not eligible for the exclusion if you excluded the gain from the sale of another home during the two-year period prior to the sale of your home.

4. If you can exclude all of the gain, you do not need to report the sale on your tax return.

5. If you have a gain that cannot be excluded, it is taxable. You must report it on Form 1040, Schedule D, Capital Gains and Losses.

6. You cannot deduct a loss from the sale of your main home.

7. Worksheets are included in Publication 523, Selling Your Home, to help you figure the adjusted basis of the home you sold, the gain (or loss) on the sale, and the gain that you can exclude.

8. If you have more than one home, you can exclude a gain only from the sale of your main home. You must pay tax on the gain from selling any other home. If you have two homes and live in both of them, your main home is ordinarily the one you live in most of the time.

9. If you received the first-time homebuyer credit and within 36 months of the date of purchase, the property is no longer used as your principal residence, you are required to repay the credit. Repayment of the full credit is due with the income tax return for the year the home ceased to be your principal residence, using Form 5405, First-Time Homebuyer Credit and Repayment of the Credit. The full amount of the credit is reflected as additional tax on that year's tax return.

10. When you move, be sure to update your address with the IRS and the U.S. Postal Service to ensure you receive refunds or correspondence from the IRS. Use Form 8822, Change of Address, to notify the IRS of your address change.

Foreclosure activity continues to slow.

According to RealtyTrac, a national foreclosure-tracking firm, the number of foreclosure filings nationwide fell 35 percent as compared to July 2010, a statistic suggesting that the housing market continues to improve.

“Foreclosure filing” is a catch-all term encompassing default notices, scheduled auctions, and bank repossessions.

Filings fell to a 44-month low in July 2011.

For all the improvement, though, activity remains concentrated in just a few states. More than half of all bank repossessions last month occurred in just a handful of states.

In July, 6 states accounted for 52% of activity.

1. California : 19% of all repossessions

2. Georgia : 8% of all repossessions

3. Florida : 7% of all repossessions

4. Texas : 6% of all repossessions

5. Michigan : 6% of all repossessions

6. Arizona : 6% of all repossessions

At the other end of the spectrum is Vermont. With just 11 repossessions for all of July, Vermont accounted for 0.016% of repossessions nationwide.

Distressed homes are in high demand with today’s home buyers. According to the National Association of REALTORS®, they account for 30% of all home resales. That’s no surprise, either.

Distressed homes typically sell at 20 percent discounts as compared to non-distressed ones.

But, if buying a foreclosure is in your agenda, be sure to do your homework. Buying bank-owned homes is different from buying from “people”. The contracts are different, the negotiations are different, and the homes are sometimes sold with defects.

If you plan to purchase a foreclosure in Scottsdale, Gilbert, Chandler,Mesa, or Apache Junction including Gold Canyon , therefore, be sure to speak with a licensed real estate agent first. There’s plenty of available information online but when it’s time to buy, have an experienced agent on your side.

Make sure you have a HUD agent if you are looking at HUD homes, have an experienced HUD agent on your side.

More Americans are getting back to work.

The latest Non-Farm Payrolls survey from the Bureau of Labor Statistics shows that 117,000 net new jobs were created in July, thumping analyst estimates and surprising Wall Street investors.

In addition, May and June’s originally-reported figures were both revised higher:

§ May 2011 was revised higher by 28,000 jobs

§ June 2011 was revised higher by 28,000 jobs

The national Unemployment Rate slipped to 9.1 percent.

The jobs report’s strong readings would typically be a boon to stock market and a threat to mortgage rates. This is because more employed Americans means more disposable income spent on products and services; and more taxes paid to governments at the federal, state and local level.

This combination fuels consumer spending and supports new job growth, a self-reinforcing cycle that spurs economic growth and often to draw investors into equities.

This month, however, the market reaction has been decidedly different.

Since the Friday release of the July Non-Farm Payrolls report, the Dow Jones Industrial Average has lost close to 6 percent of its value. Furthermore, mortgage bonds — which typically sink on a strong jobs figure — have thrived.

High demand for mortgage-backed bonds have pushed mortgage rates below their all-time lows set last November; the biggest cause of which is Standard & Poor’s credit downgrade of U.S. government-issued debt.

Ironically, the credit rating downgrade sparked a surge of safe haven bidding that has been tremendous to rate shoppers and home buyers in Mesa and nationwide. Bond buyers are flocking to the U.S.

If you’ve been shopping for a mortgage, therefore, or recently bought a home, use this week’s action to your advantage. Call your lender and ask about rates. You may be surprised at what you find.

What do you do with a computer repair company that will not work on your machine? The tech says " there is a bad sector on the disk so we aren't allowed to work on your machine".... so why do I pay you a monthly fee? Has anyone else had this problem and how did you fix it, besides firing them?

The FHA is insuring a greater percentage of loans than during any time in recent history. In 2006, it insured roughly 5 percent of the purchase mortgage market. Today, it insures one-quarter. ”Going FHA” is more common than ever before — but is it better?

The answer — like most things in mortgage — depends on your circumstance.

Like its conforming counterpart, an FHA-insured mortgage is available as a fixed-rate loan and as an adjustable-rate one. Payments are made monthly and come without prepayment penalties.

That’s where the similarities end, however, and decision-making begins. For homeowners and buyers across Scottsdale , FHA mortgages carry a different set rules as compared to conforming loans through Fannie Mae or Freddie Mac that can render them more — or less — attractive for financing.

For example:

§ FHA mortgages can be assumed by a subsequent buyer. Conforming loans may not.

§ FHA mortgages require mortgage insurance, regardless of downpayment. Conforming loans do not.

§ FHA mortgages do not have loan-level pricing adjustment. Conforming loans do.

FHA mortgages also require smaller downpayment requirements versus a comparable conforming mortgage. FHA calls for a minimum downpayment of 3.5%. Conforming mortgages often require 5 percent or more.

And, lastly, FHA mortgages are priced differently from conforming ones. Since 2005, the average FHA mortgage rate has been below the average conforming mortgage rate more than 50% of the time, meaning that an FHA mortgage’s principal + interest payment is lower than a comparable Fannie/Freddie loan.

Today, conforming mortgage rates are lower.

So, which is better — FHA loans or conforming ones? Like most things in mortgage, it depends. FHA-insured loans can be big money-savers or money-wasters. To find out which is best for you, ask your loan officer for today’s market interest rates and study the results.

With less than 20% equity, the answer is often clear.

Great Networking Meeting this Morning

Today's networking meeting was informative; we talked about the 100,000 homes that have been foreclosed on, However they are not on the market. So, we chatted on why are the banks are holding them. This is what we came up with.

1. They are so unorganized that they do not know what to do with them

2. They are waiting for the market to recover some for better price point

3. Maybe they have been told to hold them until a certain time, then release them slowly

4. Maybe they do not even know they have all these homes on their books.

(1-4 is not factual... just what we thought of)

You may not be aware that when the bank has these properties on their books it keeps them from lending, for every dollar they have on their books, they must have a reserve of seven dollars.

New Short Sale Twist from B of A

Initiating a New short sale with Bank of America on the Equator system. We all have done it many times. Has anyone gotten the RED screen that tells you to call Customer Care?

I did today, well my sellers have a loan that you cannot process in Equator, they will not tell me what type it is because the third party authorization letter cannot be uploaded. It must be faxed, and then they have up to 5 business days to process and get it in the system. Great... she says just fax all the paperwork you have. NOT.. it will just be lost, I am going to get this authorization in... then lets talk to someone and then I will be faxing... yes, faxing .... the pages and pages of documents.

Power outage mess

We were caught in the power outage that happened in Mesa. I did loose some data, and web stuff. Some of it went a wee bit crazy.. Just trying to get it all straightened around today

. It has been a slow morning with the 4th of July weekend here.

You forget how much you depend on certain things, electricity and cooling... The phones went down, and of course the fax machine. That was the day Qwest had picked for my DSL upgrade, oh yes that went well NOT! That is another story and not a pleasent one. I am glad that day is in the past, now just to fix a few things.

A Sad Day at A Western Adventure

Today is a very sad day we are saying good-bye to one of our old boys. Jesse James, his team mate Frank James is still with us. Jesse had a stroke in the early morning; he has been made comfortable while the vet comes. Jesse has pulled many kids through box canyon on haunted hayrides, cookouts, parades and the Wal-mart safety parade (pictured below). He will be greatly missed; he was loved and happy to the end.

Today he takes his one last ride! Everyone will remember all the memories he created and all the stories that were told on those rides by the James brothers.

Today after class we thought that we would go to Red Robin... Bill, Austin, and I off we went to the local Red Robin.. What a time we had. First they sat us by the kitchen, so we could see and hear everything that went on in the Kitchen... that was okay, until one of the waitresses started cleaning the warming lights... oh yes there was food under them.. GROSS.... thank goodness we had our food... I would have left. The manager walked right by her doing that. Later Bill asked the manager if she saw that? She responded no..... if I would have been thinking, I should have used the video on my phone... I do not think I want lunch at Red Robin again.

HUD Awards $73 Million to Housing Counseling Organizations

The Obama Administration announced on Thursday a round of grants totaling nearly $73 million to more than 500 national, regional, and local organizations to provide housing counseling services.

The funding, provided by the United States Department of Housing and Urban Development (HUD), will allow hundreds of thousands of households the chance to find housing or stay in their homes. The funding represents a 22 percent increase over last year’s funding.

“These organizations are on the front lines of helping families who are desperate to remain in their homes,” said HUD Secretary Shaun Donovan.

He continued,“Now, more than ever, it’s crucial that we support these agencies that are working with struggling families on a one-to-one basis to manage their money, navigate the home buying process, and secure their financial futures.”

The counseling grants will assist families in becoming first-time homeowners and in remaining homeowners once they have a house. The HUD-approved counseling agencies provide both homeownership counseling and financial literacy training to renters and homeless people.

Nearly $68 million will provide housing counseling services by 24 national and regional organizations, five multi-state organizations and 484 state and local housing counseling agencies.

Counseling agencies will receive $9.5 million of the grant to help assist senior citizens with reverse mortgages or Home Equity Conversion Mortgages. The remaining $5 million is awarded to three national organizations to train, instruct, and certify more than 4,000 counselors to assist families.

Agencies receiving the grants will also focus on helping home buyers and homeowners evaluate their readiness for home purchase, and understanding financing and down payment options. The agencies will also help combat predatory lending by helping borrowers review loan documentation and avoid potential mortgage scams, inflated appraisals, high interest rates, and other issues that can lead to problems down the road.

“It is crucial that Americans better understand how to manage their money, navigate the home buying process, and secure their financial future.” said Donovan. “This critical funding will help counseling organizations continue to assist families in making more informed choices before they purchase a home and counsel families facing foreclosure.”

Foreclosures Fall to Lowest Level Since 2008 on Robo-Signing Delays

New data from RealtyTrac shows that foreclosure activity last month fell to a level not seen since November 2008, after problems with paperwork prompted case reviews, foreclosure suspensions, and re-filings of affidavits by mortgage servicers.

Foreclosure filings nationwide in November dropped 21 percent from the previous month and 14 percent from a year earlier. For the first time since February 2009, RealtyTrac says the total number of filings for the month dipped below the 300,000 mark. The company tracked foreclosure filings – including default notices, scheduled auctions, and bank repossessions – on 262,339 U.S. properties during November.

That equates to one in every 492 U.S. homes hit with a foreclosure notice or taken back by the lender during the month, compared to one in every 389 homes during October.

James Saccacio, RealtyTrac’s CEO, said “While part of the decrease can be attributed to a seasonal drop of 7 to 10 percent that typically occurs in November, fallout from the foreclosure robo-signing controversy forced lenders and servicers to hit the pause button on many foreclosures while they scrambled to revamp their internal procedures and revise or resubmit questionable paperwork.”

According to RealtyTrac’s report, a total of 78,955 properties received default notices in November, a 21 percent decrease from the previous month and a 31 per-

cent decrease from November 2009. While the robo-signing scandal may have impacted the short-term numbers, this marked the 10th straight annual decline in default notices.

RealtyTrac says default notices in states that practice judicial foreclosures plummeted 31 percent from the previous month. Meanwhile non-judicial default notices decreased 9 percent between October and November.

Foreclosure auctions were scheduled for the first time on a total of 115,956 properties in November, a 16 percent decrease from the previous month and unchanged from November 2009. Scheduled judicial foreclosure auctions dropped 34 percent month-over-month, while scheduled non-judicial foreclosure auctions were down 7 percent from the previous month.

Lenders foreclosed on 67,428 homes in November, a 28 percent decline from October and 12 percent fewer than in November 2009. Bank repossessions, or REOs, decreased month-over-month in 37 states and the District of Columbia, according to RealtyTrac’s study.

November’s REO total was the lowest since May 2009, but November’s numbers pushed the year-to-date 2010 REO total to more than 980,000 – already above the record year-end total reported by RealtyTrac for 2009.

Despite a 20 percent monthly decrease in foreclosure activity, Nevada posted the nation’s highest state foreclosure rate for the 47th straight month. One in every 99 Nevada housing units received a filing in November – nearly five times the national average.

Thanks in part to sharp monthly drops in foreclosure activity in Arizona, Florida, California, and Michigan, Utah’s foreclosure rate leapfrogged to second highest among the states last month. One in every 221 Utah homes received a foreclosure notice in November.

California ranked third on RealtyTrac’s list of the highest state foreclosure rates, with one in every 233 housing units receiving a filing last month. Other states on the company’s top-10 list in November were Arizona, Florida, Georgia, Michigan, Idaho, Illinois, and Colorado

Banks Suspend Foreclosures During The Holidays Once Again This Year

For the second time in as many years, several of the largest mortgage players in the mortgage market have indicated that they will not evict borrowers in default who are facing foreclosure during the two weeks surrounding Christmas.

Fannie Mae and Freddie Mac, the two government-controlled mortgage entities that back many home loans, are freezing all foreclosure evictions on mortgage loans they own or back from Dec. 20 through Jan.3.

Evictions mark the end of the foreclosure process. After the home is sold at foreclosure auction -- or banks take possession of the home -- owners must leave the property or face eviction notices.

"If the property is occupied, our foreclosure attorneys will suspend the eviction to provide a greater measure of certainty to families during the holidays," said Anthony Renzi, executive vice president of single family portfolio management at Freddie Mac.

In addition, three of the largest mortgage servicers, Bank of America, Wells Fargo and Chase have also all three indicated that they will follow suit as well with a foreclosure freeze during the same two week period as Fannie and Freddie.

However, these servicers have also indicated that the will continue the foreclosure process for loans they service that are held by investors who decline to participate in the freeze and for properties that are known to be vacant.

Even though this is only a two week freeze, with the number of bank repossessions amounting to almost 100,000 per month, the temporary stoppage could affect tens of thousands of borrowers in default over the holiday season.

I am enjoying seeing all the families, singing, smiling, laughing.. while on the hay ride. Wishing everyone a Merry Christmas. Seeing all the Air Force Families and their children is really special. Bill and I really appreciate their service to our Country. The Luke Air Force base is one of my favorite hay rides as my dad was Air Core, that is what they called the Air Force in World War II.

Well this is my rant! Are there any good cleaning people? I am just going to scream into a pillow, we hired a company to come and clean, I can’t tell you how bad it has been,,,,, If someone has any recommendations I would love it!

This has been terrible, counters not wiped down, cupboards not wiped out, bath tubs not cleaned, and the carpets were vacuumed, so she could do that, they claim they do move out and move in cleaning… No they don’t.

Short Sales are never the same!

Here is the newest I have run into; I am the listing agent on this property. Buyer’s agent shows the property to the wife, they write an offer. They include the Additional Clause addendum for the absente spouse. They request that he see the home on Sunday. So far so good. Then the buyer’s agent tells me that the Buyers are in an accepted contract on another short sale, they are waiting on bank approval, and have been waiting for over 2 months. How much longer will it take to get the approval? Hmmmm, and it isn't BofA.

The agent tells me the Buyers are not willing to sign the counter offer, because I asked for written cancelation of the other short sale. The agent couldn't believe that I asked for that. I can't believe that they wrote on another home, and told me about the other offer, how I could let my sellers accept and then ... have the buyer cancel in 4-5 weeks when their other offer was approved. My Sellers need the home sold, with a buyer that wants to perform and close on the home.

I am asking for a non refundable earnest deposit for the first 60 days. Also has anyone run into Title Company issues? On my authorization form I have my title company and person, so they can talk to the lender if issues come up, with a short sale they will. I am not willing to put the Buyer’s Title person on my authorization, personal, and confidential information could be disclosed to the wrong person? I would love some thoughts on this and yes, I was asked to do this!

You've all been here before, so lets all close our eyes and imagine this scenario together, shall we? The funds are in the bank, the inspections are done, everything's been signed off, and the buyer is ready, willing, and able to sign the loan docs and get this closed. Granted, we had to ask for an extension on the closing date once already thanks to the ever 'prudent' lender, but here we are, the day before the closing date, every last duck in a row--oh wait, there's the phone.
"We need a declaration page on two properties."
...Alright. The buyer owns a couple of homes, yeah we knew this, not a big surprise on our part, but--couldn't they have decided this a month ago? Did this really have to wait until the day BEFORE closing before realizing that gee, that's not in the file!
So. They now have the papers. Still waiting. Called the lender this morning, and got the usual 'let me call you back. Called him back at noon, 'let me call you back'. ...Still waiting. Oh, boy.

Frustration!!!

My poor Buyers, they found a great home that had everything they were looking for, and what a killer back yard! The house was beautiful, new appliances in the kitchen, granite counter tops….etc. An offer is written, a full price offer is written… Yes!!! Listing agents, full price…WOW. The Seller has rejected the offer, yep!!!! can you believe it? Rejected the offer, here is why. The home will not appraise, the Seller and Listing agent know it will not appraise, so the offer is turned down, the Seller is looking for a CASH offer, or someone that will pony up the 20 or so thousand dollars when the appraisal comes in low. The Seller will not reduce the price of the home to meet the appraisal. The last 8 homes have had appraisal problems, really…. When I list a home I don’t seem to have this problem. Yes, the listing agent really told me that! WOW… what happened to pricing homes correctly? As a Buyer’s Agent, I can’t tell my buyers to proceed with another offer on this home, or pay more for a home than current market/ appraised value.

My Dad was in World War II, here he is in uniform.

I was always proud of him for his service. I do remember the stories he would tell, some good some bad. :-)

When he passed away my Mom was awarded a flag for his service. Now I am the keeper of his flag. On a happier note, I thought all the grandkids and great grandkids would like to see this photo.
